从超国家与国家间的职能分割到超国家失灵——以欧盟《稳定与增长公约》失灵为例 被引量:1

摘要 欧洲一体化进程中存在着一对重大的内在矛盾 ,即超国家和国家间的职能分割必然会导致两个决策层次在特定条件下产生目标和政策冲突 ,并可能最终导致超国家失灵。作为国家治理延伸的产物 ,欧盟的超国家层面只能从成员国的有限让渡中形成自己的职能范围。但是 ,这同时也把原来统一从属于国家的政府职能领域条块分割到了超国家和国家两个决策中心手中 ,从而造成割裂职能领域间有机联系和治理失调的风险 ,考虑到民族国家在欧盟内部的主导性地位 ,这完全可能带来超国家失灵的严重后果。欧盟《稳定与增长公约》 There is a significant inner contradiction in the process of European integration, the division of competence between supranational authority and the nations. The division could lead to conflicts of goals and policies between the two decision-mak ing levels, and ultimately result in malfunction of the supranational governance. As a result of governance extension, the competence of the EU at supranational level comes form the limited sovereignty transferred from its member states. Neverthe less, the government competence originally belongs to different nations is divided into two decision-making centers-supranational authority and nations, thus lead to the risks of separation of organic links between different competence fields and maladjustment of governance. Take the decisive position of the EU member states into consideration, we could assume that it will cause serious malfunction of supra national authority.
