摘要
在行政实践中,依法行政与依政策行政并存,这一现象有以下启示:在依法行政的理论探索中,需要认真对待理论与实践之间的差异;从依法行政实践的角度看,依政策行政具有有限合理性,是我国迈向现代化进程中特定历史阶段的必然产物;从社会学的角度来理解,依政策行政就是在依法行政;从研究方法看,依法行政的理论研究应当多作一些田野调查,更好地接近研究对象。
The coexistence of administration according to law and administration according to policy inspires us in the following aspects. First, we shall treat the differences between theory and practice seriously. Second, administration according to policy, with limited rationality, is the necessary outcome of our special history phrase in the course of modernization. Third, administration according to policy is administration according to law in the angle of sociology. Forth, the theoretical study of administration according to law shall be close to practice.
