摘要
违宪审查作为一项最程式化、法制化的宪法实施方式,应遵守:(1)无讼案则无审查原则;(2)法律合宪性推定原则;(3)程序性审查与实体性审查相结合原则;(4)政治问题不审查原则。
As an important mode of constitutional enforcement, constitutional review should abide by the following principles: the principle of limited retroaction, the principle supposal of law constitutionality, the principle of unity of procedure and substance, the principle of exception of political issues.
