摘要
刑事诉讼的一系列活动是围绕着证据展开的 ,学界和实际工作部门对证据的价值判断存在两种不同的认识 ,即客观真实与法律真实之说 ,就现代刑事诉讼的证据理念和发展趋势来看 。
The series of activities in criminal lawsuits are focused on evidences. Whereas on the judgment of value in evidences there are two different views, i.e. the objective trueness and legal trueness, by the circle of scholars and by functionaries, from modern criminal lawsuit evidence concept and its development trend, legal trueness should be chosen as the value orientation in criminal lawsuit evidencing.
