摘要
中国的社会结构正在逐渐形成一个国家与社会并立互动的二元结构,这就为民间法的继续存在与发挥作用提供了社会条件。由于国家、社会二分而形成的大、小传统的阻隔为民间法的存在提供了文化土壤,在处理国家法与民间法的关系上,不是一方对另一方的挤压与消灭,而是在相互尊重的基础上进行理性的对话与沟通。
The social structure of China has gradually changed into dualistic structure with coexistence and interaction of the country and the society, which offers both social conditions for the continuous existence and role of the nongovernmental law and the cultural ground. As a result, while dealing with relations between the constitutional law and the nongovernmental law, we should make rational dialogues and communications on the basis of mutual respect.
