摘要
后合同义务是合同终止后,当事人依法律规定,遵循诚信原则,根据交易习惯应当履行的以维护给付效果及协助相对人处理善后事务的附随义务。其内容是根据诚信原则及交易习惯形成的,具有不确定性,属独立的合同义务。后合同义务制度的建立,完善了合同义务体系,实现了债权法追求合同履行效果的圆满及扩张对交易安全的保护。
The liability after contract is the attached liability after contract end the party should perform to safeguard the gien effect and assist other party to handle affairs concerned in light of related law,deal customs and honest and credit principle.Its content is the independent contract liability which has been evolved auording to honest and credit principle and deal customs and has indeterminacy.setting up liability system after contract and perfecting contract liability system realizes perfection and expansion of performin contract effect and safeguarding deal.
