摘要
中美人权问题是两国关系中的结构性问题。美国人权观源于自然法理论,强调人权的普遍性和个人人权,着眼于个人的政治权利。中国人权观源于马克思主义伦理和儒家伦理传统,既强调个人人权,又强调集体人权,认为人权既包含政治权利,也包含生存发展权、社会文化权等多种要素。中美双方应在了解和尊重对方伦理传统的前提下,加强人权对话与合作,求同存异,增进共识,努力化解人权冲突,发展中美关系。
The human rights problem between America and China is a structural problem in the relation between the two countries. The view on human rights in America originates from the theory of natural law, emphasizing personal rights and the universality of human rights, focusing on political rights. The view on human rights in China originates from Marxist ethics and the tradition of the Confucian ethics, emphasizing both personal rights and collective rights, and holding that the human rights contain both political rights of the people and life rights, social cultural rights of the people, etc. Under the prerequisite of understanding and respecting the other side's ethical tradition, the two countries should promote dialogue and cooperation in human rights, seek common ground while reserving differences, turn hostility into friendship, develop the two countries' relations.
