摘要
网络空间是人类的第二生存空间,对法律产生了巨大的影响。网络空间的技术性特征对国家的立法权形成冲击,网络的无国界性影响国家法的适用,虚拟性使社会主体的个人意识膨胀,法律责任感淡化;网络空间的分散式管理模式对宪法基础关系产生影响,其全球性特征使得全球法的地位加强,而无纸化与即时性特征对私法产生了革命性的影响。以功能等同、技术中立原则为基本原则构建全新的网络法律制度,无论是对社会的发展,亦或对法学的发展都具有重大意义。
Cyberspace, the second existence space of man, has great influence on law. Technological attribute of cyberspace has a sharp impact on the national legislative power. The boundless attribute cyber affects the application of the national law. The virtual attribute expands the individual consciousness of the society as a whole and weakens the awareness of legal responsibility. The dispersed administrative pattern of cyberspace influences the base of constitutional law. The global attribute strengthens the status of the global law. The sheetless and simultaneous attributes bring a revolutionary influence on the private law. The bran-new cyber law established with the principles of functional-equivalent and technological neutrality is very important to the development of both society and law science.
