摘要
商标本身可以牵引着三个方面的关系:商标与其标识的商品或服务的关系;商标与其所有者或使用者之间的关系;商标与其社会公众或消费者之间的关系。商标不仅仅是一个商业概念,而且是一种法律概念,体现了相应的法律关系。从法律上规制这些关系的制约因素就是——商标的显著性。
Trademark oneself appears three relations, trademark and its sign of goods or services, trademark and its ownership or employment,trademark and the social public or consumer. So the trademark,with its commercial and legal notions,is a legal rela-tion which is controlled factor-distinctiveness.
