摘要
全球化趋势使得整个国际社会越来越向组织化、法制化和民主化的方向发展,这对主权国家的外交产生了深远的影响。因此有必要从国际法、国际社会和主权国家之间的互动的关系来考察外交变化和发展。但传统国际法对外交的理解和界定是比较狭隘的,这落后于急速变迁的国际政治现实。国际法既给国家的外交设定了很多限制,也拓宽了国家的外交空间;既增强了主权国家外交解决问题的能力,但同时在一些问题领域又弱化了主权国家的作用。
The international society is developing towards organization, rules of law and democracy in the course of globalization. This trend is exerting significant influence on the diplomacy of the sovereign states. Therefore, it is necessary for us to perceive the change and development of the diplomacy of the sovereign states under the interaction among international law, international society and sovereign states. The traditional analysis and definition of diplomacy in the theories of international law, however, are much narrower, which is backward the rapid change of reality of international politics. International law sets up much restriction on the diplomacy of the states. On the other hand, it also widens the space of the diplomacy of the states. International law strengthens the ability of resolving problems, at the same time, it also weakens the role of the sovereign states on some issues.
