摘要
“人权高于主权”是美国等多国部队入侵南斯拉夫和伊拉克的伦理依据。但仔细分析 ,“人权高于主权”是非道德的 ,第一 ,它并不能最大限度的维护人权 ;第二 ,它有悖道德义务 ;第三 ,作为一个道德判断它也是违反“普遍性原则”的。“人权高于主权”的实质是霸权主义国家的侵略理论工具。
Human rights above sovereignty” is the important ethical foundation of the US-led multi-national force's invasion into former Yugoslavia and Iraq, but deeper analysis shows that the theory is immoral at all. Firstly, it could not safeguard full respect for human rights. Secondly, the proposition goes against the natural moral law. Finally, as an ethical criterion it violates the universal principle of human moral values. In essence the argument of “human rights prior to sovereignty” is the theoretical tool for some countries to carry out hegemonism and power politics.
