摘要
《最高人民法院关于适用〈中华人民共和国婚姻法〉若干问题的解释(一)》(以下简称《解释》)的出台无疑具有重大意义,但《解释》中的部分规定也不尽合理。如补办登记后,婚姻关系的效力应从双方以夫妻名义同居生活时,而非从双方均符合结婚的实质要件时起算;对"不能独立生活",应做广义解释,只要因客观原因确无独立生活能力,而致生活困难的都应包括在内,在校大学生也不例外;以住房提供帮助的形式应只包括居住权,不包括所有权。
It is no doubt that the appearance of Judicial Interpretation (One) of Many Issues on how to Apply The Marriage Law of China launched by the Highest People's Court is significant. This article puts forward different opinions in view of the interpretation, and holds that after supplemental marriage register, the effect of marriage should begin from the cohabitation in the name of a couple; 'Can't live independently' should be interpreted in a broad sense, and those who can't live independently for objective reasons should all be included. University students are no exception. The form of helping with housing should only include the living right and exclude the ownership of the house.
