摘要
诉讼中的证明标准是一个争议颇为激烈的理论问题。本文从比较法的角度 ,对形成各种证明标准的历史条件和标准环境进行了比较对照 ,并从诉讼实践的价值取向等角度 ,对客观真实、法律真实和实体真实的标准加以分析 ,提出了正当程序的要求之下追求实体真实的必然性 。
The standards of proof in court proceedings are a highly controversial subject. In the present paper, the author compares, historical environments and legal conditions which produced varied standards of proof. The author also makes an analysis on the standards of objective authenticity, legal authenticity and substantial authenticity under value orientations in litigant practice. Thus,the author proposes the necessity to pursue substantial authenticity on the basis of due process, and he also emphasizes the indispensability of scientific evidence.
