摘要
日本经济法因其特殊的历史背景在诞生之日起便突破了传统经济法危机对策法的定位,形成了一系列的赶超型的法律制度。反思中国经济法,特殊的时期与特定的原因给予其改革先锋与代位法的历史使命,却在市场的不断完善中日益呼唤其赶超型法律的崭新定位。
Because of the particular background of the birth , Japanese economic law has broken its traditional situation in Western Countries, and made a series of exceeding legal institutions . Reviewing Chinese Economic law , the distinctive society and times gave it the mission to reform planned economic system and replace the civil law . But with the developing of the market economy ,Chinese economic law should organize its exceeding legal institutions.
