从英美判例法的特点入手,分析了判例法的借鉴意义,在阐述中国建立民商判例制度作用的基础上,论述了我国民商判例制度的建立。
The case law has it抯 own characteristic and can contribute to perfect our law system. This article discusses the necessity of the design of China抯 civil case law system and assume how to establish China抯 case law system of civil and business law.
