摘要
域名应属于知识产权的范围,是一种与商标、专利并列的新型的知识产权,因为其是创造性的智力成果,完全具备了知识产权的三大基本特征,即地域性、专有性、时间性。域名权作为一种新的知识产权,其权利内容应该包括人身权、专有使用权、标识权、转让权、许可权。
Domain name in network, as a new terminology, is disputable in the regards of its property attributive. Some think it is kind of trademark property, some believe it is kind of credit, and some believe it is kind of intellectual property. In my opinion, domain name belongs to the category of intellectual property, a new intellectual property in parallel to trade mark and patent, as it is creative intelligence result, with the three basic features of intellectual property, i.e. territorial, proprietary, and time relevant. Domain name property as a new intellectual property, shall include personal rights, proprietary enjoyment, and rights for identification, for transference, and for license.
