摘要
本文认为,全国人民和政府之间的委托代理关系并不存在,并运用经济学和法学知识对两者的关系进行分析,结果表明两者的关系更符合表见代理的要件,可以看成是表见代理的关系。在此分析基础上,本文提出了基于表见代理的国有资产管理研究思路。
According to this paper, the principle-agency relationship between citizens and the Government doen't exist. Based on the theories of law and economics, an analysis is proposed:that the relationship between citizens and the Government is more likely to meet the requirements of apparent-agency. Finally, the article gives us some clues for the research of SOAs management.
