摘要
水资源是关系到人类生存与发展的重要自然资源。水权制度在实现水资源多元价值方面发挥着不可替代的作用,是解决我国水危机的关键所在。但目前建立我国现代水权制度的问题主要是理论界对水权的认识模糊以及有关水权制度的立法极其滞后。因此,本文着重阐明了水权的涵义,并就我国水权制度立法中存在的问题提出了完善的建议。
Water resource is very important for human beings survival and development. Water rights system, which plays an irreplaceable role in realizing the multi-values of water resource, is the key to solve the water crisis in China. But there are many problems in setting up China's modern water rights system for the time being. For one thing, the academic circle does not have a clear understanding about water rights, for another, the legislation on water rights system is awfully lagging. Therefore, it is an urgent task to define water rights and perfect the law on water rights system.
