摘要
特留份制度是遗嘱继承中的一项重要制度 ,它是对遗嘱自由原则的合理限制 ,具有独特的价值和功能。世界各国均普遍采用了这一制度。由于种种原因 ,我国继承法尚无特留份制度的规定。随着社会的发展 ,目前在我国继承法中设立特留份制度已日益显现出其迫切性和必要性。采取这一制度将有助于克服现有社会弊端 ,体现社会利益与社会正义 。
The system of forced portion is of great importance in the inheritance by will, which is a reasonable limitation to the principle of freedom of will. Owing to its peculiar value and function, almost all the countries in the world adopt this system. However, there are still no stipulations about this system in Chinese law of inheritance due to various reasons. With the development of society, to adopt this system in Chinese law of inheritance seems more imminent and necessary. Adopting this system will help to overcome some current social evils and embody the social benefits and social justice. In addition, it will meet the needs of social development.
