摘要
协商方式作为解决医疗纠纷的重要途径,具有便捷、成本低,效率高,有利于缓和医患关系等优势。本文在探讨协商解决机制利弊的基础上进一步提出完善策略:1.医疗机构应以更中立的立场,遵循诚信、公正、合理的原则与患方进行协商解决;2.复杂纠纷和死因不明的纠纷应将医疗事故技术鉴定作为前置程序;3.签订协议书应严格执行《条例》规定,恪守民法的诚信原则,有针对性地对协议进行公证以强化法律效力;4.轻微的医疗差错,卫生行政部门应给予医疗机构必要的协商空间,在限定金额内允许补偿,免去上报要求;5.医疗机构应和新闻媒体、公安机关建立良好的沟通渠道;执法机关应坚持公正原则,加大保护医疗机构合法权益的力度。
As an important way for the solution towards medical disputes, the negotiated method has the advantages such as convenience and quickness, low cost, high efficiency and benefit to relaxing relationship between medical providers and patients etc. Based on the exploration of the advantages and disadvantages of the mechanism for negotiated solution towards medical disputes, further, the article outlines the strategies to improve the mechanism : 1. medical institutions should be at an even more neutral position in conducting negotiation with patients for the solution in the principles of sincerity and faith, fair - minded and reasonable way; 2. technical assessment for medical incident should be a pre- procedure for complicated disputes and the disputes without clear death cause; 3. signing agreement should strictly follow the{Regulation)and principles of sincerity and faith in civil law, in view of special cases, the agreement should go through notarization in order to enhance the legal validity; 4. for minor medical errors, the health administrative sectors should give necessary room for medical institutions to negotiate with, to allow making compensation within certain amount of money without asking reporting them to higher levels; 5. medical institutions should develop good communication channel with media/ press and public security sectors, law enforcement organs should stick to the fair - minded principle to enhance the strength to protect lawful rights and benefits of medical institutions.
