摘要
新婚姻法存在不足和缺憾的原因是在立法上未处理好继承与创新、单行法律与法典化、民族性与世界性、大众化与专业化、法律调整与道德调整等关系,并逐一浅析。主张民族传统应予继承,内容和体制应有创新,着眼于法典化和世界法治潮流,兼顾大众化和专业化,并将法治与德治有效地结合起来。
There are still some shortcomings in the marriage law.The reason is that it does not maintain proper relations between the following aspects:inheritance and development;single law and the whole statute;nationality and the world;popularity and specialization;law regulation and specialization;law regulation and moral regulation,etc.The author analyses then one by one and advocates that ou r national tradition should be inherited,but the contents and system can be developed,and when we set up a law,we should follow the tendency of the world laws,take both popularity and specialization into consideration,combine law with morals effectively
