摘要
中国“有文本宪法而无实在宪政” ,“有形式法制而无实质法治” ,原因何在 ?中国历史上市民社会的缺失和现实中市民社会的不成熟是中国难以实现宪政与法治的根本症结。因此 ,中国建立宪政之途和走向法治之路就是培育和形成成熟的市民社会。为了加快中国市民社会的成熟 ,以为宪政与法治铺垫基石 ,我们应该进一步推进经济的市场化 ;进一步加强政治民主化和权力监督 ;进一步推动社会利益分散化和利益多元化 ;进一步推动思想意识和文化的多样化。
There is constitution but no constitutional government and there is law but no rule of law in China. In history, China was lack of civil society, and the civil society of China is not mature at present, which is the crux of the matter of constitutional government and rule of law. Putting forward marketization in economy,promoting democratization,strengthening supervision of state power in politics,further dispersing of social interest and permitting pluralization of ideology and culture are not only the necessities of mature civil society,but also the foundations of constitutional government and rule of law.
