摘要
以科技为起因的越界损害给传统国家责任理论提出新的挑战,有必要从法理上在越界损害的国家责任领域导入严格责任。严格责任是指一国不论有无过失,均对行为所引起的损害担负赔偿的责任。严格责任是越界损害责任的基础。
Aggression upon the rights brought about by science and technology challenges the traditional theory of state liability. And therefore it is necessary to introduce strict liability into the field of state liability concerning aggression upon the rights of the victimized country. Strict liability law stipulates that the aggressor country must hold liability for any damage done to the victimized country.Strict liability forms the basis of the damage liability for the aggression upon the rights of the victimized country.
