摘要
新世纪的全球化进程无论是在深度上还是广度上都以史无前例的态势推进,不过最终的效果如何还要受多种因素的制约,就中国而言,要想在这一进程中使本国法律的变革与发展能合乎时代的要求,关键还在于处理好法律全球化与多元化、法律全球化与西方化、法律全球化与本土化、法律全球化与传统法律文化、法律移植与自我创制以及法律的独特性与协调性等方面的相互关系。
Globalization of the new century is proceeding at an unprecedented speed in terms of both depth and scope. However, its ultimate effect will be restrained by various factors . For China, the key to keeping the reform and development of the legal system is the maintenance of the relationships between legal globalization and legal multi-polarization, between legal globalization and legal westernization, between legal globalization and legal domestication, between legal globalization and traditional legal culture, between legal transplantation and legal innovation, and between legal uniqueness and legal coordination.
