摘要
实行举证责任倒置 ,并非要求被告证明整个案件的事实 ,而只是因实行无过错责任原则和过错责任推定原则而免除原告举证责任的那一部分事实。应该引起注意的是 ,这一部分事实有的是侵权行为 ,有的是因果关系 ,有的是由于被告的过错造成的。
To apply inverted evidential burden is not to require the defendant to prove the entire fact of the case, but to excuse the defendant from proving that part of the fact because the non-fault responsibility principle and fault responsibility deduction principle are carried out. Points should be noticed are: some of these facts are tort, causality or caused by the faults of the defendant.
