摘要
公元 1 5 0 0年前后的“地理大发现”后 ,人类社会迎来第一次全球化浪潮。在这次全球化浪潮中 ,全球范围内展现出一幅以法制现代化和全球化为内容的近代法律发展图景。1 6世纪 - 1 9世纪末的法律发展是法制现代化与全球化互动的、彼此交融的历史过程 ,是历史与现实、传统与现代的对立和统一 ,是以西方国家为主要发源地、其他国家共同参与的、多样化的法律发展历史过程 ;同时 ,法制现代化、全球化过程也暴露出明显的不平衡性和历史局限性。
After the 'Great Discovery of Geography' around 1500, human society encountered the first wave of globalization, in which the prospect of modern legal development with the modernization and globalization of legality has been exhibited in the scope of the whole world. The development of law from the 16th century to the 19th century is an interactive and mutually blending process of modernization and globalization of legality. It is the opposites and unity of history and reality, tradition and modernity, and the historical process of diversified legal development mainly originated from the western countries and participated by other countries. At the same time, the process of modernization and globalization of legality has shown the obvious imbalance and historical limits.
