摘要
本文分析了西方法哲学传统中的一对重要范畴:公域与私域。在总结现有研究的基础上,对公域与私域的划分标准及其各自的内涵进行了重新思考:对公域与私域的理解应该采取语境论的模式,区分绝对公域、绝对私域、相对公域和相对私域。并从天然状态、利益形态、价值取向、行为方式等方面分析私域与公域各自具有的内涵,对公域与私域做出了描述性而非概念式的理解。
This article makes an analysis on two important categories:the public sphere and the private sphere.After summarizing the existing achievement,the author reconsiders about the division of the pubic sphere and the private sphere.He believes that people should take a contextual attitude and distinguish among the absolute public sphere,the absolute private sphere,the comparative public sphere and the comparative private sphere.Then the article depicts the elements in the two categories.In the division between the public sphere and the private sphere,there are legal principles.
