摘要
本文论析了建设工程担保制度的本质,介绍了建设工程担保制度中投标保函、履约保函与付款保函的三种主要形式,以及其制约、惩戒承包商违约,稳定建筑市场发展等功能,分析和肯定了建筑工程担保制度在实践中所发挥的构建建筑市场公平竞争市场环境,降低业主与承包商之间的信息不对称分布,降低承包商违约行为,促使承包商信息披露的公开与公正性等作用,揭示了在我国建筑行业中采用此项制度的应用前景及其理论与实践意义。
The basic nature, main contents, and fundamental function of warranty system of construction project are analyzed in brief in paper. The system's practical functions of formulating fair competitive market environment, decreasing asymmetry between principal and agent, forbidding agent's renege, and inducing agent's opening his private information are also introduced in the paper. Its future tendency, theoretic & practical meaning of the system application in Chinese practice are put forward in the paper.
