摘要
精神损害赔偿的范围在整个精神损害赔偿制度中甚为关键,关系到精神损害赔偿请求权能否成立,请求权主体的确定及赔偿数额的计算。本文立足于民法的基本理论和现行法律法规,从精神损害的定义出发,对精神损害赔偿的范围,进行了试探性的界定。
