摘要
陪审制度的存废众说纷纭。本文摒弃单纯的理论思辨,而是运用马克思主义内外因关系的原理,从历史发展和实践检验中考察了陪审制度在中国及世界范围的发展过程,阐释了它的历史基础,指出了它在司法实践检验中表现出来的基本矛盾,探讨其客观的发展规律和基本趋势,从而显现其应有的现实归宿。
There are a variety of opinions on the establishment or abolishment of jury system. this paper, regardless of the theoretic debate, and interms of marxisim principles of internal courses from the perspective of historic development and practical examination, examines the process of jury system in China and the rest part of the word, elaborating the historic foundation of the jury system the basic contradiction in the course of judicial practice and the development rules and trend and the ultimate goal of this system.
