摘要
由于历史、政治和经济等因素导致我国内外资企业的法规制度存在着许多差异 ,这明显不符合世贸规则 ,阻碍了我国经济的整体发展。这既不利于提高我国引资质量 ,也阻碍外资的健康发展 ,同时也不利于内资企业的发展 ,使内资企业在尚未入世之时就不能与其同处于一条起跑线之上 ,处于劣势状态。对于我国来说 ,在入世后正确面对内外差别刻不容缓 ,必须对外商投资企业的法律制度加以调整。文章将从公司制度三大“基石”之一——“资本制度”
The many differences existing in the regulations for domestic and foreign enterprises are not in accord with the WTO rules, and the situation is not conducive to the overall development of the country's economy either. The article makes some researches of the current regulations for foreign invested enterprises from the perspective of capital system, and it also offers some suggestions for the reform of it.
