摘要
无单放货应承担法律责任这是毋庸质疑的 ,但到底应承担何种责任 ,司法实践和学理界都存在较大的争议 ,综合目前学说界的几种观点 ,我们对提单的功能及无单放货应负的法律责任加以分析 ,这对司法实践将起到积极作用。
It is definitely illegal to deliver goods without bi ll. However, there's a hot debate on which responsibility taken on by the accuse r in the law field. The function of the bill and the responsibilities are discus sed, which will push forward the legal practice.
