摘要
中国环境保护法应独立成为一个法律部门 ,而且这个法律部门应居于仅次于宪法 ,而同刑法、民法、经济法、行政法、诉讼法等居于同等地位 ,即第二层次的法律部门 ;其目的是衡平世代利益 ,保护人类健康和环境 ,经济发展和环境保护协调进行 ;
China Environmental Protection Act should be indepentent of other departments that is subordinated to the Constitution,equilibrating Penal Code,Civil Law,Economy Statues,Administrative Law and Procedural Law.The Act is supposed to be the secondarily important position for the purpose of balancing the good of all ages,protecting the well_fare and environment,the cooperative relation between economic growth and environmental protection.Its Principles are agreeable to ecological rules and orientation of sustainable development.
