摘要
法官地位问题是目前司法改革中遇到的核心问题之一 ,运用经济学的分析方法 ,在哈耶克自发秩序理论的基础上 ,以社会分工为逻辑起点 ,沿“经济人”理性选择的路径 ,探讨初始产权的界定以及法官所面对的内外约束机制对于法官地位形成的重要意义 ,给我们的启示是 :中国司法改革应借鉴美国法官地位确定的经验 ,建立法官排他性产权的制度保障 ,建立有效的激励与约束机制 ,实行审级中的双轨制和社会各利益集团的有限参与。
The status of judges is one of the core problens that we are facing in the judicial reform.There were expo-sition about it in academic circle from different arrangement of idea and angles.Based on Hayek's spontaneous order theo-ry,we try to introduce the analytical method of economics and discuss the importance of the definition of initial property right and the restriction mechanism which judges confront with both inside and outside,which begins with the logical starting point of social labor division and advance along the approach of rational choice of the"economic man".Through the research on the origin,consolidation and prominence of the position of the judges of USA,we want to come to the conclusion that it can be used as reference to the judicial reform of China.
