摘要
政府信息放在行政法理论和行政法规则中分析 ,必然是行政主体的一种义务 ,该义务的法律性质、该义务的具体范畴只有从较深理论层面上揭示才能为行政法治实践对它的规制、监控提供思辨基础。同时 ,行政主体的信息义务对行政法关系的理论和传统行政法关系的格局也有强烈震撼。
The governmental information is a kind of duty of administrative subject if it is analyzed by means of administrative law theory and administrative rules. The legal nature and the concrete concept of the duty can provide theoretical basis of regulation and supervision only when it is revealed from the deeper level. Meanwhile the informative duties of the administrative subject produce a strong repercussion to the structure of the theory of administrative law relation and traditional administrative law relation.
