摘要
以最高法院的司法解释为基础 ,我国精神损害赔偿制度已经基本确立。这标志着我国法律体系的一大进步。但这一制度仍需完善和补充 ,尤其是对未成人和胎儿的保护还需加强 。
The system of compensation for mental damage has been established on the base of the legal explanation of the super court,Apr,2001.It is great improvement of our legal system.The system of compensation for mental damage should be still perfected and supplemented,Especially in the protection for children and fetus.The system of compensation for mental damage should coordinate with custody.
