摘要
新闻侵权不同于一般民事侵权 ,媒体享有特殊的抗辩权 ,这是基于宪法精神和公共利益的需要 ,而且 ,我们应该对媒体抗辩理由进行正确考量 。
Press tort is different from civil tort. Based on constitutional spirit and the need of public interest, medium has special right of plea. Therefore, we should correctly consider the reasons for plea of press in order to safeguard the legitimate rights and interests of mediums.
