摘要
传统法律中的书面形式的规定 ,对通过数据电文进行的电子商务活动构成了法律上的一大障碍。为消除这一障碍 ,目前国际、国内的电子商务立法采用了一种“功能等同法”的解决方法 ,即通过将数据电文的效用与书面形式的功能进行类比 ,从而摆脱传统书面这一单一媒介条件下产生的僵硬规范的束缚 ,为电子商务创造一个富于弹性的。
The stipulations on written form in traditional laws have been a serious obstacle to e commerce activities via e data. To break the barrier, a solution called 'functional equivalent approach' is adopted to the legislation of international and domestic e commerce. Through an analogy between the effectiveness of e data and the function of written form, it creates a flexible, open standard system for e commerce, thus freeing this new type of commerce from rigid formulas of traditional written form in a single medium.
