摘要
国有化是国家主权范围内的事项。但是,随着国家间相互依赖程度的加深,各国对国有化的态度发生了变化,认为国有化的实施应具备四个法律要件:国有化必须以公共利益为目的;国有化过程中不涉及歧视;实行国有化的国家应给予外国投资者以补偿;国有化应依正当的法律程序要求进行。
Nationalization is an affair within national Sovereignty,but it has varied and conformed to a deriction with increasing inerdependencd among countries. There are four inportant legal conditions for nationalization,namely,nationalization is to agree on the public benefits and There must be no discrimination whatsoever in course of nationalization;the country that carries out nationalization must pqy proper compensation to foreign investors,and nationalization must be achieved in accordnce with legal procedures.
