摘要
在数字经济快速发展与全球要素流动加速重构的背景下,数据作为新型战略性生产要素,其跨境流动在促进国际贸易合作、区域协同发展和技术创新扩散的同时,也将国家安全风险深度嵌入网络空间与全球产业链体系之中。“数据自由流动”与“国家安全”之间的结构性张力日益凸显,尤其是在复杂多变的国际地缘政治环境下,数据跨境流动已呈现出政治安全、经济安全、文化安全、科技安全等多维度交织的风险特征。基于此,本文从总体国家安全观视域出发,系统梳理数据跨境流动的安全内涵与治理逻辑,阐释总体国家安全观在政治安全、经济安全、数据主权与发展安全等维度对数据跨境流动风险治理的系统性指导意义,进而构建以安全与发展统筹为核心的风险治理分析框架。在此基础上,本文从宏观外部环境、中观制度机制与微观实践操作三个层面揭示数据跨境流动所面临的主要风险类型与挑战,并提炼中国特色数据跨境流动治理体系的核心特征与制度路径。研究认为,将总体国家安全观嵌入数据跨境流动治理实践,是实现开放合作与安全防控动态平衡的重要基础,也是完善我国数字安全治理体系、提升国家治理现代化水平的关键方向。
Amid the rapid development of the digital economy and the accelerated restructuring of global factor flows,data,as a new strategic factor of production,plays a crucial role in promoting international trade cooperation,regional coordinated development,and the diffusion of technological innovation.However,it also embeds national security risks deeply within cyberspace and the global industrial chain system.The structural tension between“free data flow”and“national security”is becoming increasingly prominent,particularly against the complex and ever-evolving international geopolitical landscape.Cross-border data flows now entail multidimensional risks involving political security,economic security,cultural security,and technological security.From the perspective of a holistic approach to national security,this paper systematically examines the security implications and governance logic of cross-border data flows.It elucidates how the holistic approach to national security systematically informs the governance of risks associated with cross-border data flows in terms of political security,economic security,data sovereignty,and development security.Based on this,an analytical framework for risk governance centered on the coordination of security and development is constructed.The paper further identifies the main types of risks and challenges facing cross-border data flows at three levels—the macro external environment,meso-level institutional mechanisms,and micro-level practical operations—and distills the core characteristics and institutional pathways of China's data cross-border flow governance system.The study concludes that embedding the holistic approach to national security into the governance of cross-border data flows is essential for achieving a dynamic balance between open cooperation and security prevention.It also represents a key direction for improving China's digital security governance system and advancing the modernization of national governance.
