摘要
绿色消费对于解决中国当前资源与生态环境难题、引领中国实现绿色低碳转型和高质量发展、满足人民美好生活需要具有重要意义。在此背景下,生态环境法典规定绿色消费制度,既有助于绿色消费法律规范的体系化,也契合生态环境法典所贯彻的可持续发展逻辑主线和传承弘扬中华优秀传统文化的价值追求。《中华人民共和国生态环境法典(草案)》在绿色低碳发展编设置绿色消费一节,在立法上具有开创意义,《中华人民共和国生态环境法典(草案二次审议稿)》(以下简称《生态环境法典(草案二审稿)》)虽然做了较多改动,但在体系结构与内容安排方面仍有诸多改进空间。目前,中国绿色消费制度存在概念界定不一、称谓混用和体系化不足等问题。因此,该研究试运用归纳演绎和对比分析的方法,探讨绿色消费制度入典的编纂思路与体系建构,建议应明晰绿色消费制度的法典体系定位,厘清其基本概念并明确实施绿色消费的基本原则,规定政府、生产经营者和消费者的职责与义务,激励制度、标准、认证、标识、评价以及统计监测、信息平台建设等绿色消费核心制度与实施机制。针对《生态环境法典(草案二审稿)》中绿色消费相关规则存在的问题,建议从统一关键词、优化章节命名等方面优化名称表达;从概念表述、基本原则、具体条文表达等方面优化绿色发展编绿色消费一节的规则内容;对总则编、污染防治编、法律责任编绿色消费相关规则进行内容优化;从加强绿色发展编与其他编相关规则、绿色消费与其他绿色发展相关规则间的衔接协调等方面考虑,调整《生态环境法典(草案二审稿)》中绿色消费制度的规则布局。
Green consumption is crucial for addressing China's current challenges in resources and ecological environment,guiding the country toward a green and low-carbon transition and high-quality development,and meeting the people's aspirations for a better life.The Ecological and Environmental Code(hereinafter referred to as“the Code”)incorporates a green consumption system,which not only contributes to the systemization of green consumption legal norms but also aligns with the Code's overarching logic of sustainable development and its value orientation of inheriting and promoting the excellent traditional culture of the Chinese nation.The Ecological and Environmental Code of the People's Republic of China(Draft)introduces a dedicated section on green consumption in the chapter on green and low-carbon development,which is groundbreaking from a legislative perspective.The Ecological and Environmental Code of the People's Republic of China(Second Draft for Review)“hereinafter referred to as‘the Second Draft’”has made quite a few changes,however,considerable room for improvement remains in terms of the systematic structure and the arrangement of its provisions.At present,China's green consumption system suffers from problems such as inconsistent conceptual definitions,mixed use of terms,and insufficient systematization.Against this backdrop,this study adopts inductive,deductive,and comparative analysis methods to examine the codification approach and systematic construction of the green consumption system.It argues that it is necessary for the Code to clarify the positioning of the green consumption system,define its basic concepts,clearly specify the fundamental principles governing the implementation of green consumption,stipulate the responsibilities and obligations of the government,producers,and consumers,as well as incentive mechanisms,and establish core institutional arrangements and implementation mechanisms for green consumption,including standards,certification,labeling,evaluation,statistical monitoring,and information platform construction.Regarding the issues in the green consumption-related provisions of the Second Draft,this study recommends the following:optimize the terminological expressions by unifying key terms and refining the titles of chapters and sections;improve the substantive rules in the green consumption section of the chapter on green development in terms of conceptual descriptions,basic principles,and the wording of specific provisions;enhance green consumption-related rules in the general provisions,pollution control,and chapters on legal liability;and adjust the overall arrangement of the green consumption provisions in the Second Draft by considering the coherence and coordination between the chapter on green development and other chapters,as well as between green consumption rules and other green development-related rules.
