摘要
作为新兴概念的计算法学,其理工科背景的技术性应用得到法学领域的广泛认可。在著作权法视域下,以“作品”为对象的侵权判定规则存在“模糊区”的问题,失准的实质性相似判定规则不符合法治要求。著作权法第三次修订时以“视听作品”替代了“电影作品和类电作品”,扩大了对作品的保护范围,将作品的感知方式取代了作品的产生方式,因而对作品实质性相似的判定应当以人类感知方式为准。在对“实质性相似”明晰的过程中,暴露出计算法学理论渊源不足的问题。文章拟结合传统民事侵权理论的社会属性与人类的生物属性,对计算法学理论渊源的梳理,分析人类对外界信息获取的生物特征,进一步拓展计算法学的疆域至医学等领域。
As an emerging concept,computational jurisprudence has gained widespread recognition in the legal field for its technical applications rooted in science and engineering.Within the copyright law domain,the infringement determination rules targeting“works”exhibit a“gray area”issue,where inaccurate substantial similarity assessment criteria fail to meet the requirements of the rule of law.The third revision of the Copyright Law replaced“cinematographic works and works similar to cinematographic works”with“audiovisual works”,expanding the scope of work protection.This shift prioritizes the mode of human perception over the mode of work creation,thus requiring substantial similarity determinations to be based on human perception.The process of clarifying“substantial similarity”has exposed deficiencies in computational jurisprudence’s theoretical foundations.This article proposes to integrate the social attributes of traditional civil tort theory with human biological attributes,trace the origins of computational jurisprudence,analyze biological characteristics of human information acquisition,and further extend computational jurisprudence into other fields such as medicine.
