摘要
流放刑作为一种古老的刑罚手段,其起源与演变过程伴随着中国古代法律发展演变的各个阶段。研究流放刑的起源,需要首先对其概念内涵进行辨析。文献记载我国流放性质的刑罚早在上古时期已经出现,称为“流”或“放”,是将罪犯强制迁移到偏僻蛮荒的边远之地,使其背井离乡、颠沛流离,从而成为惩治犯罪、威慑警戒、维护统治的惩戒手段。在上古时代,流放刑的产生是丛林法则与政治因素共同作用的产物。考察流放刑的起源及产生原因,对探究中国古代刑罚的发展脉络具有重要意义。
As an ancient penal measure,exile punishment has its origin and evolution process,which covers every major stage of development in ancient Chinese legal history.To study the origin of exile punishment,it requires,first and foremost,a clarification of its conceptual meaning and scope.According to historical records,penalties of an exilic nature in China had already emerged in ancient times,which was referred to as"liu"or"fang,"involving forcibly relocating offenders to remote,desolate and uncivilized frontier regions.It was a means of punishment,in which the criminals were compelled to leave their native homes and wander in prolonged displacement,thereby serving the functions of punishing crime,deterring and warning others,and maintaining the existing political order.In ancient times,the emergence of exile as a form of punishment was the result of the combined effects of primitive survival principles and political considerations.An examination of the origin and causes of exile punishment is of critical importance to trace the developmental trajectory of punishment systems in ancient China.
