摘要
跨境人脸识别情报应用的系统性风险绝不是法律、技术或主权的单一挑战,更是源于三者间的深度交织与负向强化。对此,应在“主权兼容”原则下,建立基于风险场景分类的分级管控机制,采用分布式存储加强人脸识别数据治理,构建以可信边缘计算与隐私计算融合为核心的技术治理框架,推动司法认证的范式转型。结合技术刚性约束,创新国际协作机制,引入第三方信任架构,由此构建灵活的跨境数据治理体系,以适应跨境背景下人脸识别治理之需。
The systemic risks inherent in cross-border facial recognition intelligence applications extend far beyond isolated challenges of law,technology,or sovereignty.Rather,they stem from the profound entanglement and mutually reinforcing negative dynamics among these three dimensions.To address this,a risk-scenarioclassification-based tiered governance mechanism should be established under the principle of“sovereigncompatibility”.Governance of facial recognition data should be enhanced through distributed storage architectures,while a technological governance framework centered on the integration of trusted edge computing and privacypreserving computation must be constructed.This necessitates a paradigm shift in judicial authentication practices.Concurrently,innovative international collaboration mechanisms should be developed,incorporating third-party trust architectures alongside technologically enforced constraints.Such an integrated approach will forge an adaptive cross-border data governance system capable of addressing the unique regulatory demands of facial recognition technologies in transnational contexts.
