摘要
为推进生态文明建设,环境行政公益诉讼在2017年修订的《中华人民共和国行政诉讼法》中得以正式确立,并逐渐成为督促行政机关履行职责、推动环境治理的重要力量。然而司法实践中,审判机关对于行政机关不履行职责的认定仍存在法律困境,尤其在行政机关是否履职的认定标准方面,存在认定标准不统一和结果标准导向明显的问题。为更全面、科学地评价行政机关的履职行为,应当以夯实环境行政公益诉讼制度功能为基础,从规范主义和功能主义两种治理模式的角度出发,采取“履职行为在先,履职结果在后”的复合认定标准。
To promote the advancement of ecological civilization,the Administrative Procedure Law of the People's Republic of China,as revised in 2017,has officially recognized environmental administrative public interest litigation,and has been increasingly influential in propelling environmental governance and compelling administrative bodies to execute their responsibilities effectively.However,in actual judicial practice,judicial organs face legal challenges in determining administrative inaction,particularly due to inconsistent standards and a pronounced tendency toward result-oriented judgments.To more comprehensively and scientifically evaluate the performance of administrative agencies,it is essential to strengthen the functional role of the environmental administrative public interest litigation system,it is necessary to ground the assessment in a well-established functional framework of environmental administrative public interest litigation.Drawing from both normativist and functionalist models of governance,a compound standard should be adopted-prioritizing the examination of administrative conduct before evaluating the outcomes of such conduct.
