摘要
为促进我国水产种质资源保护法律法规的完善,本研究使用法律文本梳理、比较分析以及案例研究等方法,从法律、行政法规、部门规章3个层面系统梳理国内水产种质资源保护相关的法律法规,并将我国水产种质资源保护法律法规体系与发达国家的立法状况进行比较,探讨当前我国水产种质资源保护有关法律的存在问题。结果表明,我国水产种质资源保护的法律法规存在法律位阶不高、立法分散不协调、资源利用规则缺失、法律责任机制缺失等问题。针对上述问题,结合我国实际情况与国际相关经验,本研究从完善多层次的水产种质资源保护法律法规体系、构建水产种质资源的评估与监测体系、明确责任与惠益分配的法律依据、建立水产种质资源损害的惩罚与救济机制等方面提出相关对策。
By using legal text sorting methods,comparative analysis and case study,this study systematically sorts out the domestic laws and regulations related to the protection of aquatic germplasm resources from the three levels of laws,administrative regulations and departmental rules.The legal system of aquatic germplasm resources protection in China is compared with that in developed countries to discuss the shortcomings of the existing laws and regulations in China.The results show that there are some problems such as low legal status,uncoordinated legislation,lack of resource utilization rules,and lack of legal responsibility mechanism existing in the laws and regulations of aquatic germplasm resources protection in China.In response to the above problems,this study put forward relevant countermeasures from the aspects of improving the multi-level legal and regulatory system of aquatic germplasm resources protection,constructing the assessment and monitoring system of aquatic germplasm resources,clarifying the legal basis of responsibility and benefit distribution,and establishing the punishment and relief mechanism of aquatic germplasm resources damage combined with the actual situation of China and relevant international experience.
