摘要
2024年8月,A市与B市监管部门跨区域协查时发现了一起鸡蛋兽药残留超标案件。市场监督管理部门和农业农村部门分别在销售环节和生产环节对该案件进行了调查,发现关键证据链断裂:农场主否认生产该品牌鸡蛋,现场核查未见涉案包装,第三方抽检其产品亦合格,加之商标无法追溯,致使案件因无法建立抽检样品与农场的直接关联而调查中止。此案凸显出监管的三大难题:市场抽样信息与生产源头关联性弱,导致追溯困难;批发商未履行承诺达标的义务,且跨部门协查案件时存在衔接盲区;涉案证据易于灭失。建议进一步完善农业农村部门与市场监督管理部门的协作机制,明确销售环节的监管责任,以实现农产品质量安全全链条有效监管。
In August 2024,a case involving excessive veterinary drug residues in eggs was identified during a crossregional collaborative investigation by regulatory authorities in cities A and B.A break in critical evidence chain was found during the investigation at the links of sales and production by market supervision authority and agriculture and rural affairs department:the investigation was suspended due to the incapacity to establish a direct link between samples and the involved farm,owing to the facts that no production of the eggs was admitted by the farm owner,no involved packages were found on site,the eggs were qualified as randomly tested by a third party,what was worse,the eggs could not be traced through their trademarks.Following challenges in regulation were highlighted by the case:difficult traceability caused by poor correlation between data on market sampling and production sources;failure of wholesalers to fulfill their commitment to compliance,and coordination gaps during cross-departmental investigation;and perishable case-related evidences.Therefore,effective supervision over full-chain of agricultural product quality and safety was expected through improving collaboration mechanism between agriculture and rural affairs department and market supervision department,and clarifying regulatory responsibilities at the sales link.
