摘要
教育高质量发展背景下,学生处分纠纷成为高校学生管理面临的挑战。通过对典型案例和相关文献的深入分析,梳理高校学生处分纠纷的现状,并综合运用法学、教育学、管理学等多学科理论,从不同角度剖析处分纠纷的成因。同时,依据司法审查与高校自治、高校处分权与学生权利相平衡的理论,将外部驱动与内部治理相结合,构建内外联动的防范机制,有效保障学生合法权益,维护高校教育教学秩序,形成良好的教育生态,为教育高质量发展提供有力支撑。
Under the background of high-quality education development,student disciplinary disputes have become challenge to the management of college students.This research sorts out the issues of student disciplinary disputes in universities through the analysis of typical cases and relevant literature.And analyze the causes of these disputes from different angles from multiple disciplines such as law,education,and management.Based on the theories of balancing judicial review with university autonomy and university disciplinary power with student rights,it proposes a dual approach of external drive and internal governance to build an integrated prevention mechanism.This mechanism can reduce student disciplinary disputes in universities effectively,safeguard students'legitimate rights and interests,maintain the order of university teaching and education,form a good educational ecosystem,and provide strong support for high-quality education development.
