摘要
跨境电商劳动合同因行业跨国属性与用工模式灵活性,其法律适用条款需应对多重法律体系的冲突与融合问题。合法性审查需以法律适用基本规则为基础,结合劳动关系本质特征推进:首先要明确准据法选择的效力边界,重点核查意思自治原则的适用合规性、最密切联系原则的适用逻辑,以及公共秩序保留原则的具体适用情形;针对远程用工、跨境派驻等特殊场景,还需建立差异化审查标准,通过清晰界定审查的基础要素、核心维度、场景化标准与实操路径,可构建系统的审查框架,为规范跨境电商劳动关系、防范法律适用争议提供支撑,进而保障劳动合同双方合法权益与交易秩序稳定。
Due to the transnational nature of the industry and the flexibility of employment models,the legal application provisions of cross-border e-commerce labor contracts need to address the conflict and integration of multiple legal systems.The legality review should be based on the basic rules of legal application and promoted in conjunction with the essential characteristics of labor relations:first,it is necessary to clarify the effectiveness boundaries of the choice of applicable law,focusing on verifying the compliance of the principle of autonomy of will,the application logic of the principle of closest connection,and the specific application scenarios of the principle of reservation of public order;for special scenarios such as remote employment and cross-border stationing,differentiated review standards need to be established.By clearly defining the basic elements,core dimensions,scenario-specific standards,and practical operational paths for review,a systematic review framework can be constructed to provide support for regulating cross-border e-commerce labor relations and preventing disputes over legal application,thereby safeguarding the legitimate rights and interests of both parties to the labor contract and maintaining the stability of transaction order.
