摘要
当前,网络擦边软色情通过隐喻性暗示、符号包装等手段规避监管,广泛渗透于短视频、直播等新兴领域,给数字时代社会治理带来极大挑战。网络擦边软色情的广泛传播,易滋生因价值异化与性别物化催生的伦理失范、因个体越轨与群体失序诱发的违法犯罪以及因符号异化与传播畸变引致意识形态偏差的系统性风险。现阶段我国对网络擦边软色情的治理面临着立法缺失导致治理依据悬空、公众过度包容加剧道德僭越、平台双重角色削弱监管实效的三重困境。对此,在规范层面,应完善网络擦边软色情的法律规范体系;在认知层面,需重塑软色情治理的社会共识基础;在技术层面,要重构平台责任与技术治理生态体系。由此,方能筑牢数字时代的精神防线,营造风清气正的网络生态。
At present,borderline soft pornography on the internet uses metaphorical hints and symbolic packaging to evade regulation and has widely penetrated emerging fields such as short videos and live streaming,posing significant challenges to social governance in the digital age.The widespread dissemination of borderline soft pornography can easily lead to systemic risks,such as ethical misconduct caused by value distortion and gender objectification,criminal offenses triggered by individual deviance and group disorder,and ideological biases resulting from symbolic distortion and abnormal dissemination.Currently,China faces three major difficulties in governing borderline soft pornography:legislative gaps that leave governance without a basis,excessive public tolerance that exacerbates moral overstepping,and the dual role of platforms that weakens regulatory effectiveness.To address these issues,it is necessary to improve the legal framework for regulating borderline soft pornography at the normative level,reshape the social consensus on soft pornography governance at the cognitive level,and reconstruct the platform responsibility and technological governance ecosystem at the technical level.Only in this way can we build a solid spiritual defense in the digital age and create a healthy and positive online environment.
